Can you drive a license-free car with a suspended licence?
Yes, in most situations. The license-free car (a powered light quadricycle) is a vehicle in its own right, governed by the permis AM (formerly the BSR), not by the B licence. These two titles are legally independent.
If your B licence is suspended for drink-driving, speeding or loss of points, you keep the right to drive a license-free car, provided your AM licence is still valid (or that you were born before 1er janvier 1988, in which case no licence is required for a license-free car).
A simple rule to remember
B licence suspended + valid AM licence = license-free car driving allowed. This is not a grey area, it is the law.
Cases where the license-free car is allowed
Here are the situations in which you can legally get behind the wheel of a license-free car, even after losing the use of your B licence.
B licence suspended for alcohol or drugs
Suspension of the B licence for blood alcohol level or drug use does not extend to the AM licence. You can drive a license-free car again the day after the suspension, provided you stay sober.
B licence suspended for speeding
Same logic: a B licence withdrawal following major speeding does not entail suspension of the AM licence. The license-free car stays available.
B licence invalidated (points balance at zero)
Invalidation of the B licence through exhaustion of the points capital does not affect the AM licence. The license-free car is legal, and you thus avoid any break in mobility during the points-rebuilding period.
Never having taken the B licence
If you have never obtained the B licence, the question of suspension does not arise. With the AM licence (or if you were born before 1988), you drive a license-free car in full legality.
Cases where the license-free car is forbidden
Two situations make driving a license-free car illegal, even if your B licence is the only one at stake initially.
AM licence suspended or cancelled
If the suspension measure explicitly covers the AM licence (following an offence in a license-free car, for example), you can no longer drive a light quadricycle. The suspension ends on the date stated on your decision notice.
Judicial cancellation of all driving rights
Some court rulings impose a ban on driving any motor vehicle, with no exception. In that case, license-free car included, comply with the court's decision.
If you are unsure about the scope of your suspension, check the decision notice received by registered mail or ask the prefecture.
What the law says
Article L234-1 du Code de la route and the regulatory texts on light quadricycles (European directive 2002/24/CE, transposed into French law) set the conditions for driving a license-free car independently of the B licence.
A powered light quadricycle is a distinct vehicle category, governed by the AM licence. Driving it is not conditional on holding a B licence. Suspension of the B licence therefore does not automatically entail suspension of the right to drive a vehicle in the AM category, unless there is an express decision to that effect.
